Good news on pension exit fees

It appears there is good news on the horizon for up to 2 million pension savers.  The UK Financial Conduct Authority (FCA) is looking at evidence that some major providers applied exit charges to people's pensions without informing them.  In some cases, this amounted to nearly 40% of the value of the fund.

They are looking to see if they followed the rules which say they have to inform customers of any exit fees being applied.  This is good news for anyone who, in the last few years, has suffered from being in this position as they could be due compensation.

City watchdog to probe pension freedom rip-offs

The Financial Conduct Authority (FCA) has launched the investigation amid concerns that savers are in danger of being ripped off when they cash in their pensions. Insurers are to be probed by the City regulator over fears they are offering poor deals to savers who take advantage of new pension freedoms to dip into their nest eggs.

As you are probably aware from previous articles, new rules were introduced last year to allow savers to cash in their pension pots to spend as they like, rather than turning them into an annuity to pay for an income for life.  Reportedly, fears are growing that many customers are choosing the first pension their insurer offers them and risk missing out on the best deals. Findings suggest that in the final quarter of last year, 53 per cent of savers who chose to dip into their pensions stuck with the same insurer, while 57 per cent of those who signed up for an annuity didn’t move elsewhere.

Why are our pensions in crisis?

Official figures have revealed that pension funds have plummeted a further £25 million into the red. The fall in bond yields - on which pension funds rely - has increased the pressure on the pots available to support final salary scheme pay-outs. At the end of May, the pension backstop PPF (Pension Protection Fund) revealed that the roughly five and a half thousand pension schemes it monitors have a combined deficit of nearly £295 billion. This is almost £25.5 billion worse than a month earlier.

Fears for the robustness of pension pots have been highlighted by the widely reported BHS deficit.  They come as a separate study reveals some of Britain’s biggest companies are paying shareholders a dividend bonanza despite huge deficits of their own. The Pensions Regulator have issued a similar warning in the past, saying: ‘It is important that employers treat their pension scheme fairly. We expect trustees to question employers’ dividend policies where debt recovery contributions are constrained.’ 

Pension freedoms are being compromised

It has been reported recently that the new pension freedoms are not that easy to take advantage of.  Savers looking to move their funds from an under-performing pension often find that there is a high price to pay for the privilege. All too many fund managers slap hefty charges on disgruntled customers looking to make a getaway, in the shape of exit fees. These can eat up as much as five or ten per cent of your pension and also prevent many savers from taking advantage of new pension freedoms. 

UK basic state pension changes

A brand new state pension was ushered in on 6 April 2016 as a result of a massive shake-up. The new payout has been designed to make the whole process easier to understand, although it’s still far from simple.

The old system was in two parts, a basic state pension of £119.30 plus an additional pension, if applicable, with 30 years NI contributions required to get the maximum amount.  Under the new system there is a flat rate payment of £155.65 plus any protected payment for which you will need to have 35 years NI contributions to get the maximum amount.  There are also a minimum of 10 years in the NI system required to get anything at all. 

How safe is your pension?

We have all read in the press recently about the demise of BHS, but the most worrying part of the story is how this will impact UK taxpayers and BHS pensions. UK taxpayers will have to cover the statutory redundancy pay of the company’s 11,000 staff. Based on previous failures, such as Comet, city experts believe the bill will top £40 million.

At the same time, every worker in the UK who is a member of a company pension scheme will have to help fill a black hole estimated at £571million in the BHS pension scheme. This is because the Pension Protection Fund, which steps in when businesses collapse, gets its money through a levy imposed on all company schemes. 

Regular savings or not, your pension planning matters

As the baby boomers hit pensionable age, the issue of pensions has become more important politically than ever before. This is a fact which has been reflected in the raft of changes that have been made by both the current and the previous government over the past few years. Baby boomers could be forgiven for feeling a little confused by it all and even retired expats with considerable regular savings are no different; pensions and pensions rules affect all.

Whoever you are, wherever you have settled in Europe and whatever the nature of your pension scheme – final salary or defined contribution – it is essential that you get advice regarding both your expat regular savings and your pension scheme; it can mean the difference between uncertainty and security.

Safeguarding your Pension and Assets

Many UK expatriates do not realise that even if they have left and are no longer resident in the UK, they remain UK-domiciled and therefore subject to UK Inheritance Tax (IHT) on their worldwide estate at a rate of 40 per cent after allowances. This can come as a major shock. 

What can be done about this? There are several options. 

Transfers of wealth on death between husband and wife are exempt from IHT, but only if the spouse is also domiciled in the UK (or both are non-domiciled). This catches out many expatriates who have married a foreign passport holder who is likely to be domiciled elsewhere. Even then, the IHT is only delayed rather than avoided, because on the death of the survivor the tax will be payable on the passing of the family assets to the next generation.
